Silva & Cía is a well-respected IP firm with one office in Santiago and 11 IP lawyers. The firm is known for its work in trade marks, representing companies such as HBO, Microsoft, LAN Airlines, Harley Davidson and Starbucks.
In May 2012, Silva & Cía secured a significant victory for HBO in a digital copyright infringement case, at the same time setting a precedent. The firm filed a criminal action on behalf of its client against the Chilean administrator of Cuevana, an Argentine site which allows streaming of thousands of movies and TV shows without authorisation from the IP owners. This is the first case, not only in Chile, but in South America where a digital copyright crime in connection with illegal streaming of protected content was investigated and resulted in a favourable outcome for the IP owner.
In another notable matter, Silva & Cía advised LAN Airlines on all IP-related matters during its merger with TAM Airlines. It has also been hired to carry out the process of registering and protecting the intellectual property of the new entity, LATAM Airlines, the largest airline group in South America and the tenth largest in the world.
