The firm's litigation practice is driven by pharmaceutical clients on both the generic and brand side, with Mylan Pharmaceuticals a major client. But its standout case over the past year involved an electronic check-processing system developed by a US patent holding company that alleged infringement by the six largest Canadian banks. In defence of DataTreasury, Gilbert's seven-member team faced five of the country's top firms and, after the delivery of its expert reports, reached a confidential settlement. The case gained particular attention due to the damages sought, as well as issues involving the extension of privilege to the work of foreign patent attorneys and the scope of protective orders in cases involving international corporations.
