Suluk & Kenaroglu Law Office is a boutique law firm specialising in litigation in all aspects of IP law. The firm's business is based on 70% trade mark litigation and 30% patent work. After its establishment in 2001, the firm went on to cover a range of fields including pharmaceutical, textiles, information technology and energy and construction work. Suluk & Kenaroglu represents both international and domestic clients and is particularly focused on media and entertainment law. Yasemine Kenaroglu has been active in advising a client in connection with an application filed for recognition of a well known statue of the organisation's trade mark. The Turkish Patent Institute (TPI) rejected the application on the grounds that it was not spontaneously and commonly well known to the public. The case is significant because the court later accepted the application on the basis that trade marks do not have to be spontaneous or commonly known but that sectoral reputation should be deemed sufficient for recognition. This decision expands on the scope of protection in Turkey. A further example of work over the past 12 months includes representing a domestic client in the food industry in relation to an invalidation action against a former shareholder, who is also a family member. The case was concluded in favour of the client after a court decision for the invalidation of all the trade marks, including the distinctive part of the client's mark, the family name. The decision was reached on the basis that a former partnership does not provide adequate grounds for the registration of trade marks in the counter party's own name. The case was concluded in May 2010.
