Sargent & Krahn continues its reign as the sole occupant of Tier one in all disciplines this year, with peers acknowledging the firm as "the best, largest and most respected IP firm in Chile". One competitor noted: "They are excellent lawyers and they are not just big, they are good." The firm, which was established in 1889, has had particular success in anti-counterfeiting activities recently, with a 50% increase in cases compared to last year. As the attorney for the Pharmaceutical Chamber Association, partner Juan Pablo Egaña helped draft Chile's data protection laws. The firm also took part in a consultation on expanding the new trade mark and patent guidelines issued by the patent and trade mark office.
While representing the Helen Curtis company in a trade mark application case which concluded in May 2010, the firm persuaded the Supreme Court to overturn an Industrial Property Court ruling concerning its Exploit by Suave and Suave Fruit Energy brands. Sargent & Krahn successfully argued that the earlier decision was not based on the facts argued. The firm also showed that the applicant had submitted evidence of foreign registration and use of the trade marks, which were well-known commercially. Other clients include Sanofi-Aventis, Merck, Google, Unilever and Red Bull. The firm also recently attracted Honda and has since delivered seminars to Customs agents to help them spot counterfeit motorcycles.
