Gassauer-Fleissner Rechtsanwälte remains one of Austria's leading independent law firms and stays in the top Tier of the trade mark and patent litigation tables. The firm is advising Novogen in a dispute over a nutritional additive patent. Christian Gassauer-Fleissner and Dominik Göbel are representing the company in the case, which has twice been rejected by the Austrian Supreme Court. The first decision concluded with a landmark statement on the irrelevance of the prosecution history for the patent claims. The second decision broke new ground for the circumstances under which security payments can be increased. In addition to the patent case, managing partner Gassauer-Fleissner also advised pharmaceutical companies Menarini and AstraZeneca in unfair competition cases against generic companies. One international competitor comments: "Christian Gassauer-Fleissner is a pretty good litigator and I would recommend him." In trade mark work the firm, led by Max Mosing, advised Flügel on the proper use of the Red Bull mark. The beverage was being mixed with other alcoholic drinks and being called different names by individual bars. Meanwhile, the firm hired Heidemarie Mendel as a new associate but lost Veronika Wolfbauer, who joined the legal department of the Austrian industrial company OMV.
