Legarreta y Asociados

Editorial coverage

Mexico

Though a small practice, Legarreta y Asociados was described by peers as a "well-respected" boutique with an impressive client base. Founded in 1992, the firm's main focus is on IP but it also offers services in areas such as sweepstakes regulation, administrative legislation and corporate, antitrust, insurance and financial services law.

The firm represents household names such as Kodak, Praxair, 20th Century Fox, Sally Beauty and winery E&J Gallo. Name partner Luis Legarreta, who was appointed by the Mexican patent and trade mark commissioner to help draft Mexico's 1994 Industrial Property Law, was described by one competitor as "an outstanding lawyer".

In April 2010, the firm's lawyers Angelina Rugarcia and Fermin Reyes scored a victory on behalf of Nextel Communications and its Mexican subsidiary against Grupo Iusacell Celular, represented by rival firm Arochi Marroquín & Lindner. Iusacell had created a TV commercial comparing the Nextel services to an old car and its own services to a new one. The campaign incorporated the word 'next'. Legarreta y Asociados convinced the Mexican Institute of Industrial Property (IMPI) that the advert featured confusingly similar trade marks and amounted to unfair competition. The firm also successfully appealed IMPI's rejection of a trade mark application for the mark Great Grains by Kraft Foods in a June 2010 case at the Federal Court. The application had been denied on the grounds that it was too functional and descriptive to be a trade mark.
