Thure Schubert, Axel Stellbrink and Georg Andreas Rauh advised Smith & Nephew after patent holder Kinetic Concepts filed a request for a preliminary injunction against the use of foam products for negative pressure wound therapy. The case involved worldwide litigation in the US, UK and Australia. On a separate matter, Schubert, Stellbrink and Rauh advised Trans1 in further medical technology litigation. Patent holder Trans1 obtained an ex parte preliminary injunction against the use of a new device that would be part of a new method to treat the human spine. The injunction was upheld and followed by the defendant filing a revocation action before the Federal Patent Court. The matter is important given the innovative and commercial importance of the product. A further example of recent work relates to design patent and utility model litigation. Paul Kretschmar, Elard Schenck zu Schweinsberg, Stefan Fickert and Rauh advised Avon Products in connection with a request for a preliminary injunction filed against Avon for design patent and utility model infringement.
