As one of the oldest firms in the Philippines, Ortega Del Castillo Bacorro Odulio Calma & Carbonell has a rich history of success and innovation in IP. The firm, headed by a team of partners including Roane Lopez III, Ma Jasmin Blancaflor and Virna Divino, actively prosecutes patent infringement cases for such clients as German pharmaceutical companies Bayer and DuPont. A case for Bayer last year raised jurisdiction, prior resort and prejudicial question issues as the patent holder filed for infringement in regular court even though the alleged infringer filed an administrative proceeding before the IPOPhil questioning the validity of the patent in question. For DuPont, the firm successfully dealt with a third party that questioned the revival of an abandoned patent application in higher courts. The team is also working on a series of trade mark cases filed on behalf of the president and fellows of Harvard College to protect the name Harvard and several fashion marks for clients such as Dolce & Gabbana and Mango.
