Legal commentators largely attributed Katten Muchin Rosenman's successes in trade mark matters to IP national co-chair Floyd Mandell. Mandell led a team in representing Penthouse Media Group in a trade mark infringement suit filed by Roxbury Entertainment claiming exclusive rights to use the term Route 66 for any entertainment goods or audio-visual works. The Central District of California dismissed all the plaintiff's claims on summary judgment, finding the use of Route 66 was protected by the First Amendment. The case is on appeal in the Ninth Circuit.
