"I would retain it if I were an in-house counsel," notes a peer of Tsar & Tsai Law Firm. "The firm has very good litigators: Jennifer Lin is a star." One of the leading law firms in Taiwan, Tsar & Tsai has always been a formidable force in the IP market, especially on contentious issues. The firm rises up to a Tier one position on the contentious tables on the back of market recognition.
Director of IP department Joyce Ho was kept busy by several trade mark opposition proceedings in 2010. In one case, 7-Eleven engaged the team to oppose the registration of a trade mark that is similar to its registered "7-Eleven and Design" mark. The Ministry of Economic Affairs overturned the IP Office's decision in July and 7-Eleven's mark was protected.
In another highlight matter, the firm featured in a criminal case in which it successfully defended the chairman of a semiconductor company against a complaint of copyright infringement. The IP Court's decision affirmed that copyrighted work registered in the US will need to meet the requirements of the Taiwan Copyright Act to obtain copyright protection in Taiwan.
